Please read these Terms and Conditions carefully before using ubiquitous. By creating an account or using the service, you agree to be bound by these terms. If you do not agree, do not use the service.

1. Acceptance of Terms

These Terms and Conditions ("Terms") govern your access to and use of ubiquitous ("Service", "we", "us", or "our"). By registering for an account or otherwise accessing the Service, you confirm that you are at least 16 years of age and have the legal capacity to enter into a binding agreement.

2. Description of Service

ubiquitous is a productivity platform that provides tools including notes, documents, kanban boards, slide decks, canvas whiteboards, charts, calendars, and AI-assisted features. The Service is provided "as is" and features may change over time.

3. User Accounts

You are responsible for:

• Maintaining the confidentiality of your account credentials.
• All activity that occurs under your account.
• Providing accurate and up-to-date registration information.
• Notifying us immediately of any unauthorized use of your account.

We reserve the right to suspend or terminate accounts that violate these Terms.

4. Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws or regulations.
• Transmit harmful, offensive, defamatory, or illegal content.
• Infringe on the intellectual property rights of others.
• Attempt to gain unauthorized access to any part of the Service or its infrastructure.
• Distribute malware, spam, or unsolicited communications.
• Scrape, crawl, or otherwise harvest data from the Service without permission.
• Interfere with or disrupt the integrity or performance of the Service.

5. Your Content

You retain ownership of all content you create within the Service ("User Content"). By using the Service, you grant us a limited, non-exclusive license to store, process, and display your User Content solely to provide the Service to you.

You are solely responsible for your User Content and must ensure you have the rights necessary to upload and use it within the Service.

6. Intellectual Property

The Service, including its design, code, branding, and features (excluding User Content), is owned by us and protected by applicable intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Service without our express written permission.

7. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection and use of your information as described in the Privacy Policy.

We use Supabase for data storage and authentication. Data may be stored on servers located outside your home country. We implement reasonable security measures but cannot guarantee absolute security.

8. AI Features

The Service includes AI-powered features powered by third-party providers (including Anthropic's Claude). When you use AI features, your inputs may be processed by these providers in accordance with their own terms and privacy policies. Do not submit sensitive personal or confidential information through AI features.

9. Third-Party Integrations

The Service may integrate with third-party services (e.g., Google Calendar). Your use of those integrations is subject to the respective third party's terms and privacy policies. We are not responsible for the practices of third-party services.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

12. Termination

You may delete your account at any time. We reserve the right to suspend or terminate your access to the Service at any time, with or without cause or notice, including for violations of these Terms.

Upon termination, your right to use the Service ceases immediately. Provisions of these Terms that by their nature should survive termination will survive, including intellectual property provisions, disclaimers, and limitations of liability.

13. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date at the top of this page. Your continued use of the Service after changes become effective constitutes your acceptance of the revised Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with applicable law. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the competent courts in the applicable jurisdiction.
